柳乾案迪克森不可能被一级谋杀罪成判刑

一级谋杀罪，是有预谋的谋杀。要是迪克森有预谋要杀柳乾，怎么可能会在有现场目击者的情况下作案？他事后逃离现场，近3年来不承认杀害柳乾，就说明他并不想被抓住进监狱。 柳乾开门放他进来，说明他们之间之前没有严重矛盾冲突。他进来开始纠缠柳乾，并没有杀人举动，说明他去找柳乾更是为了追求她或性骚扰她。

据世界日报报道说，性侵犯致人死亡也是一级谋杀。如果真想这样判迪克森一级谋杀，又为什么检察官至今连尸检报告都没有公开？她怎么死的都不愿意说，还怎么有证据证明他性侵犯致人死亡？

迪克森现在自己承认误杀，还算有做人的最起码良心。可是检察官和法院为什么不允许他认罪？如果最后一级谋杀不能罪成，是否就让他无罪释放？

还有，这个案件完全不符合程序正义。

有哪一个案子，尸检报告近3年都拿不出来？一般几天之内就会拿出来。当时说是要做毒性试验报告所以要的时间长。哪一个研究需要3年？林俊，刘冠华被残忍肢解杀害，到现在也没有拿出尸检报告。这是不是华人的特殊待遇？

华人警官陈楚标说检察官禁止柳乾父母与记者交流。检察官有什么法律权力这样做？柳乾父母完全可以请教陈楚标。如果没有法律依据，可以立即向法庭申诉。公布原因后果。

柳乾父母却一副逆来顺受的模样，更不要说众多的华人。想起网上看到有人总结的，中国人就像猪一样，逮谁谁叫唤，其他的看热闹。

马来西亚客机事件，中国人跟全世界其他国家乘客的家属都不一样，满地撒泼打滚，寻死觅活，全然不顾体面斯文。以为中国人多么看重家庭亲情？怎么华人在加拿大美国横死，被肢解，被灭门，中国人家属就这么规矩甚至木讷了呢？其他中国人怎么就不群情激愤，义愤填膺了呢？是不是中国人的感情是有某种标准的，某种恃强凌弱欺善怕恶的势利卑贱标准。

更邪门的是那些自己就在加拿大美国的，不仅看热闹，还要叫好喊活该。有朝一日杀到他们自己了，请他们死之前意识到，那是他们自己活该，因为是他们自己鼓励纵容了这种对包括他们自己在内的中国人的非正义行为。

加拿大刑法的一级谋杀罪有一条（6）适用于一些非预谋的情况，例如袭警，有组织犯罪活动，等：

（6） Irrespective of whether a murder is planned and deliberate on the part of any person, murder is first degree murder when the death is caused by that person while committing or attempting to commit an offence under section 264 and the person committing that offence intended to cause the person murdered to fear for the safety of the person murdered or the safety of anyone known to the person murdered.........Intimidation(6.2) Irrespective of whether a murder is planned and deliberate on the part of a person, murder is first degree murder when the death is caused by that person while committing or attempting to commit an offence under section 423.1.

Intimidation的含义如下：
Intimidation (also called cowing) is intentional behavior that "would cause a person of ordinary sensibilities" fear of  or that the victim was actually frightened.

根据这些阅读，我的理解是，当犯罪分子在实行侵害他人的犯罪行为时造成被害人死亡，即可构成一级谋杀。这种侵害行为是暴力的并且使被害人感到了恐惧。
所以，警方按一级谋杀起诉迪克森是有根据的。看辩护律师有啥“暗器”可以把这个案子辩成二级谋杀吧！

酒糟， 虚心请教， 如果检方控一级谋杀， 不接受被告自认误杀， 但最后一级谋杀无充分证据， 那么可否检方退而居其次， 接受误杀？    还是最后被告因一级谋杀无充分证据，连误杀都不能算了， 而当庭释放？

楼主想说的太多啦，柳大人的千金出事了，要拿一个来祭她。在民主加拿大的环境下，想要定一个人的罪，走法律的过程是必要的，需要一定的时间的。结果就有人自我种族歧视，何况柳大人是朝廷命官，为土共编瞎话，写圣旨的，哪能受了这个过程，没有显示出他的特权来。这写手也知不好明说，就把油盐酱醋都兑在一起拿出来乎悠，结果弄得大家更看不懂。说白了，就是没显示出他是个官，土共的官，是“李钢他爸”。现在没有按某些人的意志直接判xxx个斩立决，柳大人很生气，但在加拿大，不好明发作，还得表现得很顺受的样子，要是在中国，早就把对方给这个死那个死啦。于是呢，就找个白手套出来代笔，说xxx该千刀万剐。其实奴才的智力都不咋地，这样做会适得其反。急什么呢？需等法庭判决，有罪判罪，有仇报仇，别把土共那套再拿出来，我是xxx他爹，这种作法，在民主法制国家里，会水土不服啊。
