我是一个新移民，在Mar 15 2004 – May 3 2004在实惠家居(家私)ULFERT INTERIORS (3241 Kennedy Road unit 1&2, a furniture retail) 内做Sales。公司给我的条件是基本工资$600，当销售额满$15000后我能拿到销售额的2%的commission，如果不够$15000，我只能拿$300，全部现金结算。我每天努力工作，在成功销售一件货品时我都作了简单的记录。结果我整个4月份的销售总额为$17033，应该拿到超过$900的salary，但在May 3发工资时，他们以有几张单被cancel和1张单没钱赚为由，把我的销售总额算为$14825，所以按规定只能付我cash $300。我非常愤怒与无助，所以一直和他们理论，不肯离开。后来他们以我霸占私人地方为由在May 3 (8:30—9:00 PM)找来police赶我走，police对我的处境非常同情，但表示无奈，因为他不能帮我，说我只能找lawyer和另找一份好的工作。我是新移民，没有钱找lawyer，只能靠辛勤工作生活，现在感到极度无助与无奈，也不知道应该到哪里去申诉。我每星期工作6天(11:00 AM – 8:00 PM)，工作范围早已超出sales范围，包括delivering goods，清理货仓垃圾，搬运货物，安装产品，吸尘，扫地，抹展示品，洗车，买外卖，还要帮他们洗厕所。还有一次他们要我坐bus和subway（我没有车）从Kennedy & McNicoll到 Union subway，再步行20分钟到front street & Spadina，捧着一套很重的床架给客人更换，换完还要再拿回公司。没有给我任何费用，连车费也是我自己出。他们的无耻行为使我愤怒异常，他们欺负我是新移民，工资是现金，让我有冤也没处申诉。

I am a new comer, who worked as a sales in ULFERT INTERIORS (3241 Kennedy Road unit 1&2, a furniture retail) in Mar 15 2004 – May 3 2004. The employment agreement is: basic salary is CAD600. If I make orders exceeding CAD15,000, I can get 2% commission that is CAD300. So I can get CAD900 as my salary. If it is lower than CAD15,000, I can only get CAD300.

I worked very hard and marked down all the sale record. I sale products valued CAD17,033. Finally, they only gave me CAD300 on May 3 and the reason is that my sale is lower than CAD15,000 because some order has been cancelled and some are non-profitable. At the end, my sale is only CAD14,825! I was very angry and I didn’t know what to do. I argued with them and I didn’t want to leave until they pay me what I should be paid. They called police to push me leave and said I occupied private place at 8:30-9:00. The police showed his sympathy to me but he said he can do nothing about my situation. He suggested me to ask help from a lawyer and find another job. I am a new comer and I don’t have money to pay lawyer’s service fee. All I can do is to work hard. But I feel hopeless and I don’t know what I can do. I don’t know who I can ask help from.

I worked for 6 days from Monday to Saturday every week and more than 9 hours per day (11:00am to 8:00pm). I not only sale products, but also deliver goods, clean the warehouse and even bathroom, install the product, clean dust, clean all the products, clean their private car, buy foods for them. One time, they asked me to deliver an item which weighs more than 20kg. I took bus from Kennedy & Mcnicoll to the Union Subway and I walked for more than 20 minutes to the client’s home located in Front Street & Spadina. And then to deliver the replaced item back to Kennedy & Mcnicoll! They have a car but I don’t. They didn’t even pay me TTC tickets!

Their impudence and contemptibility made me very angry. But I can do nothing because they pay me only cash and I don’t have any record about their beggary but only the Police’s affidavit on May 3.

They are used to deal with immigrants issues.  You might just want to give them a call.

You can't really make any arguments about your commission if your clients have returned the goods.

I want to ask you if you worked under the table??? You were seriously underpaid, I believe, if you'd been hired legally.  There's no way that you're only paid $600/month for working 6 days a week.

我已经至电‘华人法律援助中心’，他们给意见我可以到劳工处告他们。我已到那里登记了，开始他们说我没有任何证据与记录，不能做什么，后来商量过后还是让我递表申诉，以表示支持。其实我也知道能拿到钱的机会很微，但关键还不是钱的问题，我要维护我的尊严和伸张正义，因为他们实在是太无耻了。

Next you have to be really carefull with an employer who only pays cash!

This is called under the table deal. You can be easily ripped off.

要是有些组织或者什么别的方法可以公布这些不法商家的卑劣行经就好了；这样，哪怕法律无法解决问题，他们的名声也不会好，也算一种惩罚了。
