如果楼主一天的薪水比罚单低，就上法庭。如果你所说属实的话，个人感觉是可以胜诉的。警察只要拦下你的车，就基本会给你个罚单，不论以什么名义。
另外，法庭首先取信警察的口述，因为法官必须相信警察的职业道德，所以你在应诉时要考虑好如何陈述事件的过程，让陈述对你有利。
再者，上法庭一定要翻译，即使英语是你的母语也要要。翻译或警察有其一不到庭，你就胜诉。加拿大配备资源就是给我们用的，要善于利用所有的资源让自己胜诉。

连拿出手机看时间也不行? 那类似的做其他事呢? 如从口代里那出手(或钟)表看时间呢?. mp3也不行? 那拿CD片子插入呢? 换出呢? 看保险卡呢?

Hands-free mode allowed

(3)  Despite subsections (1) and (2), a person may drive a motor vehicle on a highway while using a device described in those subsections in hands-free mode. 2009, c. 4, s. 2.

本人是支持禁手机的，而且华人社会是最早推行此法令的，新加坡10年前就实行了，这一点加拿大只能自愧不如！

hey buddy, read #18 carefully. it only mentioned highway. highway has its own definition, not every streets are highway. if going to court, one should be able to argue with this clause.

这么明显的事你都没明白？实际上你看手机根本没什么大不了的，手机问题不过是个幌子，用来掩饰警察对你的停车检查。

可能你的车有些问题——比如和某个被盗的车辆相似——所以引起了警察的警觉。我猜测警察在最初跟踪你时，就开始在电脑上调查你的车，当发现车辆的所有人和当前的驾驶员不一致时（例如性别不同），警察决定对你进行叫停检查，所以警察不是首先指责你打手机，而是问你这是谁的车。

当警察发现你和车都没问题时，为了掩盖自己的错误（其实也不能算错误，只是为了让检查显得更合理一些），警察就随便找了一条理由（碰巧你先前还动过手机）。其实警察也就随便给你套了一条罪名，并不真的认为你打了手机，所以当你显示你有蓝牙时，警察因出乎意料而愣了一下。不过，既然只是为了找个理由，警察也不想和你多纠缠，开罚单走人。

我的一个美国同学在首都华盛顿就遇到过类似的事。当时好像是什么议员在附近的集会演讲，我这哥们碰巧迷路了在附近转了几圈，然后找个地方停下来查地图。结果一摩托骑警很快赶过来检查，并以很勉强的罪名（好像与系安全带有关）给开了罚单。我这哥们当即提出异议，那警察都懒得再搭理他，只是说了句“OK, OK, you can protest.”就走了。后来上庭，那警察压根就没露面。

所以，你就大胆地上法庭吧，我估计警察根本就不会去。即使去了，你把通话记录显示一下，和法官说明一下情况，应该会得到谅解。
