我朋友的情形是這樣的，照我朋友說的一字不漏，”我和我老公2006年7月中結婚，一直都是抱著好心情等待好消息，可是很不幸的今年2007年一月份的時侯…因為我們往的公寓以前就是做不正當的事(好像是雞院)，結果有人來查，就查到我已經沒有合法身份在加國我先生是加拿大人(但我先生在申請我的時侯，問過律師我的情況，律師說是沒問題的，而且我先生還要求律師給我一個工作証或什麼visa的，律師只跟我們說是多此一舉)所以我和我老公結婚之後我就天天在家，沒想到被查到了!! 結果移民官跟我說我被remove to outside的加拿大一年是因為ｏｖｅｒ　ｓｔａｙ，因為這個remove跟申請身份是兩回事…就算我一直跟他們說我先生已經在申請我了，他們也只能跟我們說這是兩回事。我也心裡一直很怕，所以我先生就自行定了機位讓我回國，但現在問題是，如果我回國了，那我先生申請我表格是會繼續審判還是他們就當做什麼申請都沒發生，因為我們是境內申請的，所以可以離開加拿大嘛？？希望有心人能跟我說說這種情況! 謝謝!”

You have the right to leave Canada for, say Beijing.

Once you have left, your husband can notify CIC to transfer the file to Beijing office.

If you want to stay in Canada, re-instatement of TRS is more desirable.

This problem is easy to fix.

Let me assume your husband has submitted an application for permanent status for you.

During your application, you must maintain your temporary resident status.

Even if your TRS has lapsed, submit an application for a re-instatement and an extension.

The 2 applications cost about $350.  I can't remember the exact fees.
